Taxi fare dodger who fractured woman’s arm after being served with court papers receives suspended p
A taxi fare dodger who fractured a woman's arm after she served him with court papers has been given a suspended prison sentence.
Alan Binder, of Deeping St James, Peterborough, appeared before Lincoln Magistrate's Court on Thursday 22 August where he pleaded guilty to assault and battery.
The assault, which occurred on 14 June, happened when Reverend Emma Newman attended Binder's workplace to serve court papers on him after her husband, taxi driver, Steven Newman, took legal action against him for obtaining a service by deception when he didn't pay his full taxi fare on 27 May.
Mr Newman of Bourne, Lincolnshire, was disqualified from serving the papers himself because of his role as the complainant, so his wife, who is a member of the clergy and also a solicitor, offered to serve the papers.
The Reverend initially attended Binder's home but he wasn't there, so she posted a copy of the papers through his door and then went to his place of work to serve the court papers in person. Upon finding him there, Reverend Newman explained the reason for the court papers being served, the accused then became verbally abusive about her husband.
As reported in TaxiPoint on 18 June, Reverend Newman said in her statement to police that Binder moved towards her, screwing up the court paperwork and shoving it into her chest before throwing the paperwork on the ground and storming out of his office. She then picked up the paperwork, telling Binder that she required his signature for service. However he then became more aggressive, using a number of expletives and denying any involvement in the incident.
He was then told that there was dashcam footage from inside the vehicle which would contradict his version of events, and he was being given the opportunity of doing the "gentlemanly" thing and settle his fare. He produced a wad of notes from his pocket and pulled out £15, shoving the notes into Reverend Newman's chest before pushing her toward a filing cabinet and a wall, cornering her and preventing her from escaping.
As she tried to escape, the accused struck her repeatedly on the arm and shouted at her. The Reverend managed to make an escape but Binder pursued her, pushing her into the wall.
After attending her local accident and emergency department, it was discovered that Reverend Newman had sustained a hairline fracture to a bone in her arm. Binder received a 2 year suspended sentence, 1 year probation, £500 court costs and was ordered to pay £200 compensation to Reverend Newman.
